Overview

In accordance with federal and state law, Joyner will provide both a private, clean area in close proximity to the workplace and reasonable break times for an employee to express breast milk.

General Information

Eligibility This policy applies to both full-time and part-time employees.

Length of Leave An employee who is nursing may take a paid break up to a total of one hour a day to express breast milk for up to three years after the child’s birth. This one-hour of paid break for nursing is in addition to any other available paid or unpaid breaks or meal periods.

Note: If a state exception allows longer than a one hour per day break or beyond one year after the child’s birth, Joyner will continue to consider it paid time.

Definitions “Reasonable break time” means up to a total of one hour a day. If more than one hour per day of break time for expression of breast milk is required, the employee is asked to contact HREC Services.

“Private area” means a place other than a bathroom, that is shielded from view and free from intrusion from co-workers and the public. The private area may be:

Designated, permanent space with a 5 foot turning radius clear of furnishings, a chair, electrical outlet, locking door and signage designed to prevent intrusion.

If designated space is unavailable, then an empty office, conference room or other room with a 5 foot turning radius clear of furnishings, a chair, electrical outlet, locking door and signage designed to prevent intrusion may be used.

Management should insure that the private area used by the employee includes an electrical outlet.

The Company is prohibited from:

Interfering with, restraining or denying the exercise or attempt to exercise rights under this law

Discharging, firing, suspending, expelling, disciplining or any other discrimination against an employee who exercises his/her rights under the law

Discharging, firing, suspending, expelling, disciplining or any other discrimination against an employee who opposes any practice made unlawful under this law.
