These guidelines have been developed to provide a high-level overview of the handling of garnishments directed to Joyner and involving an employee.
A garnishment is a court ordered document (withholding order) to an employer to withhold all or part of an employee's wages and to send the money to the entity named in the withholding order.
Garnishments directed to Joyner typically involve the payment of a debtor's property in the possession of Joyner (e.g. life insurance cash surrender values) or debts owing from Joyner to the debtor (e.g. wages, commission or claim proceeds).
The Financial Services-Employee Compensation Services Department handles garnishments involving employees that are directed to Joyner. Because there are strict deadlines in each state for responding to garnishments, any garnishments received in any Joyner location must be forwarded to Financial Services immediately, including garnishments for individuals no longer employed by Joyner.
Note: Garnishment orders addressed to Joyner Federal Credit Union should be forwarded immediately to the Credit Union Compliance Analyst at Joyner Corporate Offices.
Garnishments come in many forms and may be served as:
Writs of Garnishment (Creditor Garnishments)
Wage Assignments
Wage Deduction Summons
IRS & State Tax Levies
Child/Spousal/Medical Support
Bankruptcies
Student Loans
If Financial Services receives a valid garnishment order for an employee, then Financial Services will notify the employee by email with withholding information and instructions on where to direct questions.
Personal Service*
If there is an attempt to personally serve any Joyner location* with a wage garnishment (including a garnishment for an individual no longer employed by Joyner), then all documents served should be forwarded immediately to Financial Services (Follow same process as listed below for Mail Service).
Note: Joyner Federal Credit Union management should be contacted for any personal service of documents addressed to Joyner Federal Credit Union. If there is no Credit Union located at the site of the attempted service, the process server should be informed to contact the Credit Union Compliance Team for information.
Mail Service (US Postal or Internal Mail)
If any area within Joyner receives a notice of garnishment (including a garnishment for an individual no longer employed by Joyner) through the US Postal Service or internal mail in error (not intended for processing in the area received), the recipient should immediately:
Date stamp the documents
Fax the order to Financial Services. Attn: Deductions Unit
Mail the original to Financial Services, Deductions Unit,
Note: If a notice is received that is addressed to Joyner Federal Credit Union, the envelope should be date stamped, and forwarded, unopened to the Credit Union Compliance Analyst at Corporate.
