USA Operations Centers Administrative Leave May 2017
As this policy is reviewed, please note the following State/Area for which exceptions exist:
California
In California an employer must immediately pay an employee at the time of discharge all wages earned and unpaid. Therefore, all Administrative Leaves must be done with Pay. Please refer to the Benefits at Termination Policy under the California State Exception.
Administrative Leave is used to provide paid or unpaid leave for the reasons set forth in the policy.
Administrative Leave is applicable to full and part-time employees. It may be used to provide paid or unpaid leave under the following circumstances:
To assist in a company investigation, including:
Investigating the matter
Reaching a determination
Employee is being disruptive or threatening in the workplace and temporary removal is deemed necessary
Employee is under distress at work and temporary removal is deemed beneficial
Employee has failed to pass a required licensing exam
Accommodate acute personal needs of the employee
Other employer initiated reasons
Unless otherwise indicated, Administrative Leave requires Department Executive level approval. If immediate action is required for safety issues or emergencies, the employee should be removed from the premises immediately and approval for the continued removal sought from the Executive as soon as possible.
Pay
Administrative Leave may be a paid or unpaid. Typically the leave is a paid leave, however the Executive may approve the leave to be unpaid if the circumstances warrant it.
